Rulemaking – Chapters 9 and 41 of D.C.M.R.

Chapter 9 (Net Energy Metering) of Title 15 (Public Utilities and Cable Television) of the District of Columbia Municipal Regulations (DCMR)

• Notice of Proposed Rulemaking (NOPR) – The Public Service Commission issued a NOPR to amend Chapter 9 (Net Energy Metering) of Title 15 (Public Utilities and Cable Television) of the District of Columbia Municipal Regulations (DCMR). The proposed rules amend Chapter 9 to comport with “Community Renewable Energy Amendment Act of 2013,” by amending subsections 900,906, and 999 and adding new sections 907,908,909, and 910.- September 12, 2014
• Notice of Second Proposed Rulemaking – The Public Service Commission issued a second NOPR giving notice of its intent to amend and adopt the following amendments to Chapter 9 of Title 15 of the DCMR. The Commission plans to further amend subsections 906, 907, 908, and 999. This NOPR replaces the NOPR published on September 12, 2014. – January 30, 2015
• Notice of Final Rulemaking (NOFR) – The Public Service Commission adopted amendments to the following subsections of Chapter 9 of Title 15 of the DCMR: 900, 906, 999. And, added new sections 907, 908, 909, and 910. – May 8, 2015
• PEPCO’s proposed Procedural Manual for Implementation and Administration of Community Renewable Energy Facilities in response to the NOFR published on May 8, 2015 – June 22, 2015

Chapter 41 (The District of Columbia Standard Offer of Service Rules) of Title 15 (Public Utilities and Cable Television) of the District of Columbia Municipal Regulations (DCMR)

• Notice of Proposed Rulemaking (NOPR) – The Public Service Commission issued a NOPR to amend Chapter 41 (The District of Columbia Standard Offer Service Rules) of Title 15 (Public Utilities and Cable Television) of the District of Columbia Municipal Regulations (DCMR). This rulemaking proposes to amend the Commission’s rules regarding Standard Offer of Service to account for changes to the 1999 Act made by the Community Renewable Energy Amendment Act of 2013, as well as make clarifying non-substantive changes to these rules. This rulemaking amends the following subsections to incorporate CREA related changes: §§ 4100.3, 4101.2, 4102.1, 4102.4, 4103.1, 4103.4, 4104.3, 4107.1, 4108.2, 4108.3, and 4199.1, and new subsections 4107.14, and 4109. Additional non-substantive amendments in the following sections: §§ 4100.5, 4102.3, 4103.3, 4105.1, 4105.6, 4105.7, 4105.9, 4107.5, and 4107.11. – September 12, 2014

The Commission plans to further amend sections and subsections §§ 4101.2, 4103.3, 4105.7, 4107.14, 4109.3, and 4199, as well as non-substantive changes throughout sections §§ 4100, 4101, 4102, 4103, 4104, 4105, 4106, 4107, 4108, 4109, 4110, 4111, and 4199. This NOPR replaces the NOPR published on September 12, 2014. – January 30, 2015
• Notice of Final Rulemaking (NOFR) – The Public Service Commission adopted amendments to the following subsections of Chapter 41 of Title 15 of the DCMR: §§ 4100.3, 4101.2, 4102.1, 4102.4, 4103.1, 4103.4, 4104.3, 4107.1, 4108.2, 4108.3, and 4199 and the addition of new subsections §§ 4107.14, and 4109, while non-substantive changes are made in the following subsections: §§ 4100.5, 4102.3, 4103.2, 4103.3, 4105.1, 4105.5, 4105.6, 4105.7, 4105.9, 4107.5, 4107.11. – May 8, 2015
