Summary of September 19th Open Meeting

The Public Service Commission of the District of Columbia (Commission) approved 13 actions items before the Commission at its September 19, 2018 Open Meeting.

The matters include:

1. Formal Case No. 950, In the Matter of the Investigation into the Payment Center Operations of VerizonWashington, D.C., Inc., and VAPLR2018-01, Annual Report of Authorized Payment Location. This Order grants Verizon Washington, DC Inc.’s (“Verizon DC”) Motion to File Notification of the Closing of Authorized Payment Locations with the Commission Out of Time and finds Verizon DC’s request to waive the requirement that Verizon DC have an Authorized Payment Location in Ward 5 moot since Verizon DC has found a new APL in Ward 5.

2. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. This Order grants Verizon Washington, DC Inc.’s (“Verizon DC”) Request for DC Universal Service Trust Fund (“DC USTF”) Funding Application for the Second Quarter of 2018 for the provision of Lifeline telephone service to low-income District of Columbia customers. The Commission directs the DC USTF Administrator to reimburse Verizon DC $12,548.33 for the Second Quarter of 2018 within 15 days of the date of this Order.

3. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia. This Order approves and adopts the Standard Offer Service (“SOS”) Working Group’s proposed Wholesale Full Requirements Service Agreement (“WFRSA”) and Request for Proposals (“RFP”) for the 2018 - 2019 SOS Solicitation as modified by this Order. This Order also directs the SOS Working Group to file a complete final copy of the WFRSA and RFP for the 2018 - 2019 SOS Solicitation with the Commission Secretary by October 3, 2018.

4. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the District Department of Energy and Environment’s (“DOEE”) Invoices for the Third Quarter of Fiscal Year 2018 for the payment of Utility Discount Program administrative expenses. The District of Columbia Universal Service Trust Fund is directed to pay $5,359.71; Potomac Electric Power Company is directed to pay $32,228.63; Washington Gas Light Company is directed to pay $32,187.55; and DC Water is directed to pay $32,251.11 to DOEE within 15 days of the date of this Order.

5. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order denies as moot the District of Columbia Department of Energy and Environment’s Motion for Limited Engagement of Consultants to Provide a Roadmap in Formal Case No. 1130.

6. Formal Case No. 1144, In the Matter of the Potomac Electric Power Company’s Notice to Construct Two 230 kV Underground Circuits from the Takoma Substation to the Rebuilt Harvard Substation and from the Rebuilt Harvard Substation to the Rebuilt Champlain Substation. This Order denies the Petitions to Intervene filed by the District of Columbia Government, the Apartment and Office Building Association of Metropolitan Washington, the Baltimore-Washington Construction and Public Employees Laborers’ District Council, and Solar United Neighbors of D.C. at this time. 

7. Formal Case No. TA 06-5, In the Matter of the Notification of Transfer of Control of Mitel Cloud Services, Inc. to Mitel Networks, Inc. This Order accepts the Notification of Mitel Networks Corporation, Mitel US Holdings, Inc., Mitel Delaware, Inc., Mitel Networks, Inc., formerly ShoreTel, Inc. and Mitel Cloud Services, Inc., of the transfer of control of Mitel Cloud Services, Inc. from Mitel Delaware, Inc. to Mitel Networks, Inc. Further, the Commission dismisses review of the Notification for lack of Commission jurisdiction.

8. Formal Case No. TA 06-5, In the Matter of the Joint Application of MLN TopCo Ltd., Mitel Networks Corporation, and Mitel Cloud Services, Inc. f/k/a Mitel NetSolutions, Inc. for Approval to Transfer Control of Mitel Cloud Services, Inc. to MLN TopCo Ltd. This Order dismisses the Joint Application of MLN TopCo Ltd., Mitel Networks Corporation, and Mitel Cloud Services, Inc., requesting approval of the transfer of control of Mitel Cloud Services, Inc. to MLN TopCo Ltd. for lack of Commission jurisdiction.

9. Formal Case No. TA 06-4, In the Matter of the Notice of the Indirect Transfer Control of magicJack VocalTec ltd., and YMax Communications Corp., to B. Riley Financial, Inc. This Order accepts Notice of B. Riley Financial, Inc. and magicJack VocalTec Ltd., of a merger transaction whereby B. Riley Financial, Inc. will acquire ultimate control of magicJack VocalTec Ltd. and its indirect wholly-owned subsidiary YMax Communications Corp. Further, the Commission dismisses additional review of this Notice for lack of Commission jurisdiction.

10. RM3-2014-01, Utility Consumer Bill of Rights and Formal Case No. 1140, In the Matter of the Investigation into the Establishment of a Purchase of Receivables Program for Natural Gas Suppliers and Their Customers in the District of Columbia. This Order adopts amendments to Sections 327.36 and 327.37 in Chapter 3 of Title 15 of the District of Columbia Municipal Regulations, governing the exchange of information between natural gas suppliers and the natural gas utility, and the enrollment process for customers switching natural gas suppliers. The rules in Attachment A of this Order will become effective upon the date of publication of the Notice of Final Rulemaking in the D.C. Register.

11. RM402017-01, In the Matter of 15 DCMR Chapter 40 – District of Columbia Small Generator Interconnection Rules and Formal Case No. 1050, In the Matter of the Investigation of Implementation of Interconnection Standards in the District of Columbia. This Order establishes a RM9 Net Energy Metering Working Group to address: (1) system upgrade costs related to the interconnection of community renewable energy facilities (“CREFs”); and (2) to review the Commission’s Net Energy Metering Rules and propose CREF-specific rule changes for the Commission’s consideration. The Commission directs Staff to issue a Public Notice convening the RM9 Net Energy Metering Working Group within thirty (30) days of the date of this Order. Additionally, the Commission directs that the Non-wires Alternatives to Grid Investments working group, established by Order No. 19432 in the Formal Case No. 1130 docket, consider utility ownership of energy storage devices and other distributed energy resources. The Non-wires Alternatives working group shall submit its recommendation on the subject to the Commission for consideration. 

12. RM472017-01, In the Matter of the Investigation into the Public Service Commission’s Rules Governing the Licensure and Bonding of Natural Gas Suppliers and Natural Gas Consumer Protection Standards in the District of Columbia, GT96-3, In the Matter of the Application of Washington Gas Light Company, District of Columbia Division, for the Authority to Establish a New Rate Schedule No. 1A and Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order adopts final rules governing Natural Gas Suppliers in the District of Columbia in Chapter 47 of Title 15 of the District of Columbia Municipal Regulations. The rules shall become effective upon publication of the Notice of Final Rulemaking in the D.C. Register.

13. RM462015-01, In the Matter of the Investigation into the Public Service Commission’s Rules Governing the Licensure and Bonding of Electric Suppliers in the District of Columbia and Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order adopts final rules governing Retail Electric Suppliers in the District of Columbia in Chapter 46 of Title 15 of the District of Columbia Municipal Regulations. The rules shall become effective upon publication of the Notice of Final Rulemaking in the D.C. Register.
