The Public Service Commission of the District of Columbia approved four action items at its March 25, 2020 Open Meeting.

The matters include:

1. Formal Case No. 1130, theOrder regarding the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. Order No. 17912 opened the proceeding to identify technologies and policies that can be implemented in the District to modernize the distribution energy delivery system for increased sustainability (MEDSIS).

2. Formal Case Nos. 1115, 1142, and 1162, the Order regarding Washington Gas Light Company’s Motion to further extend PROJECTpipes 1 plan and the Proposed Procedural Schedule for PROJECTpipes plan. Order No. 20313, grants in part and denies in part the Washington Gas Light Company’s Motion to further extend PROJECTpipes 1 Plan and proposed procedural schedule for PROJECTpipes 2 Plan.

3. Formal CaseNos. 1115 ,1142, 1154, and 1162, the Order regarding the Scope of Formal Case No. 1162. Order No. 20314 denies the Office of the People’s Counsel for the District of Columbia’s Motion to hold Formal Case No. 1162, in abeyance Pending Resolution of Washington Gas Light Company’s PROJECTpipes 2 Application in Formal Case No. 1154.

4. PEPIA2019-01, the Order regarding the Potomac Electric Power Company’s Request for Approval of an Independent Accountant. Order No. 20315, granted the request of the Potomac Electric Power Company for Approval of an Independent Accountant.
 

Summary of March 18th Open Meeting

The Public Service Commission of the District of Columbia approved three action items at its March 18, 2020 Open Meeting.

The matters include:

1. Formal Case No. 1017, the Order regarding the Potomac Electric Power Company’s Proposed Retail Rates for Standard Offer Service. Order No. 19838, approved the Potomac Electric Power Company’s revised retail rates, including the administrative charges, for Standard Offer Service.

2. Formal Case No. 1142, the Order regarding the Sierra Club’s Petition to Intervene Out-of-Time. Order No. 20310, in the Matter of the Merger Application of AltaGas Ltd. And WGL Holdings, Inc., dismissed the Sierra Club’s petition to intervene as moot.

3. Formal Case No. 1144, the Order regarding the Office of the People’s Counsel’s Application for Reconsideration of Order No. 20274. Order No. 20274 denied the Office of the People’s Counsel’s Motion for additional procedures.

The Public Service Commission of the District of Columbia approved one action item at its February 5, 2020 Open Meeting.

The matter include:

1. Formal Case No. 1156, In the Matter of the Application ofthe Potomac Electric Power Company Authority to Implement a Multiyear Rate for Electric Distribution Service in the District of Columbia. Order No. 20293 addresses the Potomac Electric Power Company’s Joint Motion for Partial Summary Judgement and Related Relief.
 

Summary of January 29th Open Meeting

The Public Service Commission of the District of Columbia approved two action items at its January 29, 2020 Open Meeting.

The matters include:

1. RM13-2019-01, the Order and Notice regarding Amendments to Chapter 13, “Rules Implementing the Public Utilities Reimbursement Fee Act of 1980”, of Title 15 of the District of Columbia Municipal Regulations. RM13-2019-01 amends certain sections and deletes references within the District of Columbia’s Municipal Regulations to update and clarify the Commission’s assessment rules.

2. Potomac Electric Power Company (“Pepco”) State of the Company Report: Formal Case No. 1119, in the Matter of the Joint Application of Exelon Corporation, Pepco Holdings, Inc., Potomac Electric Power Company, Exelon Energy Delivery Company, LLC and New Special Purpose Entity, LLC for Authorization and Approval of Proposed Merger Transaction. Pursuant to Case No. 1119, the Commission directed the Potomac Electric Power Company (“Pepco”) to comply with several reporting requirements during and following the implementation period of the merger. 
 

Summary of January 22nd Open Meeting

The Public Service Commission of the District of Columbia approved seven action items at its January 21, 2020 Open Meeting.

The matters include:

1. Formal Case No. 1130, theOrder regarding the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. Order No.1130 directed Pepco to have funds released from the MEDSIS Fund to address “make ready” infrastructure.

2. Formal Case No. 1130 and 1155,the Order regarding the Potomac Electric Power Company’s Transportation Electrification Implantation Tariff. Order No.1130 and 1155 gives notice of actions related to the Potomac Electric Power Company’s proposed tariff revisions to address “make ready” infrastructure and the matter of the application of the Potomac Electric Power Company’s approval of its transportation electrification program.

3. Formal Case No. 1159, the Order regarding the Joint Application for Approval of the Second Biennial Underground Infrastructure Improvement Projects Plan and the Financing Order Application.Order No.1159 gives notice of the DDOT and Pepco jointly filed application for approval of the Second Biennial Underground Infrastructure Improvement Project.

4. RM29-2019-01, the Order and Notice regarding Amendments to Chapter 29, “Renewable Energy Portfolio Standard”, of Title 15 of the District of Columbia Municipal Regulations. RM29-2019-01 revises certain sections of its Renewable Energy Portfolio Standard rules in accordance with the CleanEnergy DC Omnibus Amendment Act of 2018. 
 

Summary of December 18th Open Meeting

The Public Service Commission of the District of Columbia approved seven action items at its December 18, 2019 Open Meeting.

The matters include:

1. Formal Case No. 1130, theOrder regarding the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. Order No.1130 directed Pepco to have funds released from the MEDSIS Fund to address “make ready” infrastructure.

2. Formal Case No. 1144,the Order regarding the Potomac Electric Power Company’s Notice to Construct Two 230 kV Underground Circuits from the Takoma Substation to the Rebuilt Harvard Substation, and From the Rebuilt Harvard Substation to the Rebuilt Champlain Substation (Phase II). In Order No. 1144 Pepco proposes to construct two 230kV underground transmission lines and to upgrade aging infrastructure.

3. Formal Case No. 1156, the Order regarding the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. Order No.1156 Granted Authority to Implement a Multiyear Rate Year Plan for Electric Distribution Service in the District of Columbia.

4. Formal Case No. 1156, the Order regarding the Office of the People’s Counsel’s Motion to Compel. Order No.1156 denied the Office of the People’s Counsel’s Motion to compel the Potomac Electric Power Company to provide responses to the Office of the People’s Counsel Data Request.

5. Formal Case No. 1156, the Order regarding the Baltimore Washington Construction and Public Employees Laborers’ District Council’s Motion to Compel. Order No.1156 denied Baltimore Washington Construction and Public Employees Laborer’s District Council’s Motion to Compel the Potomac Electric Power Company to Compel Responses to BWLDC’s Data Request.

6. Formal Case No. 1161, Order regarding the Application of the Potomac Electric Power Company for a Certificate Authorizing the Company to Issue and Sell Debt Securities. Order No.1161 gave notice of its approval of the Application of the Potomac Electric Power Company (Pepco) for a certificate authorizing the Company to issue and sell up to $1.2 billion of long-term secured or unsecured debt securities.

7. RM9-2015-01, the Order regarding the Potomac Electric Power Company’s Motion to Waive Part of 15 D.C.M.R. § 906.1. Order RM9-2015-01 granted the Potomac Electric Power Company’s Motion to Waive Part of 15 D.C.M.R. § 906.1. 
 

Summary of November 6th Open Meeting

The Public Service Commission of  the District of Columbia approved fourteen action items at its November 6, 2019 Open Meeting.

The matters include:

1. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. Order No. 988 approves the 2020 calendar year District of Columbia Universal Service Trust Fund budget.

2. Formal Case No. 1115, In the Matter of the Application of Washington Gas Light Company’s Request for Approval of a Revised Accelerated Pipeline Replacement Program; Formal Case No. 1142, In the Matter of the Merger of AltaGas, Ltd. and WGL Holdings, Inc.; and Formal Case No. 1154, Washington Gas Light Company’s Application for Approval of PROJECTpipes 2 Plan. Order No. 1115 grants the Non-Unanimous Joint Motion for Enlargement of Time to File Settlement Conference Report. The Settlement Conference Report shall be filed no later than December 13, 2019. If a settlement cannot be reached by that time, the Commission directs the parties to submit a consensus procedural schedule by that same date, December 13, 2019. 

3. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. Order No. 1130 directs Pepco to have funds in the amount of $12,345.65 released from the MEDSIS Fund Subaccount to Smart Electric Power Alliance within 15 days of the date of this Order.

4. Formal Case No. 1142, In the Matter of the Merger of AltaGas, Ltd. and WGL Holdings, Inc. Order No. 1142 approves WGL’s Term No. 3 Plan as directed by this Order and grants the National Consumer Law Center’s Motion to Enlarge Time for Filing Comment on Plan to Implement Commitment No. 3.

5. Formal Case No. 1142, In the Matter of the Merger of AltaGas, Ltd. and WGL Holdings, Inc. Order No. 1142 conditionally accepts AltaGas’ Term No. 5 Plan as directed by this Order.

6. Formal Case No. 1148, In the Matter of the Investigation into the Establishment of Energy Efficiency and Energy Conservation Programs Targeted Towards Both Affordable Multifamily Units and Master Metered Multifamily Buildings Which Include Low- and Limited-Income Residents in the District of Columbia. Order No. 1148 designates OPC, DOEE, the National Consumer Law Center, as well as Commission Staff to the Energy Efficiency and Energy Conservation Task Force.

7. Formal Case No. 1158, In the Matter of the Application of Washington Gas Light Company for a Certificate of Authority Authorizing it to Issue Debt Securities. Order No. 1158 approves WGL’s (“Company”) Application for a certificate authorizing the Company to issue and sell debt securities and preferred stock.

8. Formal Case No. 1159, In the Matter of Applications for Approval of Biennial Underground Infrastructure Improvement Projects Plans and Financing Orders. Order No. 1159 grants the petitions to intervene of WGL, AOBA, and the Baltimore Washington Construction & Public Employees Laborers’ District Council.

9. PEPRAD 2019-01, In the Matter of Potomac Electric Power Company’s Residential Aid Discount Compliance Reports and Filings and Formal Case No. 1120, In the Matter of the Investigation into the Structure and Application of Low-Income Assistance for Electricity Customers in the District of Columbia. This Notice of Final Tariff approves Pepco’s Revised Residential Aid Discount Surcharge. The Surcharge will become effective upon publication of this Notice in the D.C. Register.

10.RM41-2017-01, In the Matter of 15 DCMR Chapter 41- District of Columbia Standard Offer Service Rules. Order RM41-2017-01 grants Pepco’s request for a waiver of the implementation date of Section 4105.9 of Title 15 of the DCMR as directed by this Order. 

11.RM37-2017-01, Natural Gas Quality of Service Standards and Reliability Performance and Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of Washington Gas Light Company, District of Columbia Division, in the District of Columbia. Order RM37-2017-01 adopts final amendments to the Natural Gas Quality of Service Standards and Reliability Performance Rules in Chapter 37 of Title 15 of the DCMR. The amendments will become effective upon publication of a Notice of Final Rulemaking in the D.C. Register.

12.General Docket 2019-02, Decertification of Renewable Generating Facilities Submitted by Greenwalt Solar. This Order decertifies eight (8) certified generation facilities of Greenwalt, filed by Greenwalt, effective November 18, 2019, unless Greenwalt Solar presents evidence within 10 days from the date of this Order why the eight (8) facilities should not be decertified.

13.RM41-2019-01, In the Matter of 15 DCMR Chapter 41-District of Columbia Standard Offer Service Rules. Order RM41-2019-01 Notice of Final Rulemaking adopts amendments to, the Standard Offer Service Rules in Chapter 41 of Title 15 of the DCMR. The amendments will become effective upon publication of this Notice in the D.C. Register.

14.Formal Case No. 787, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service. Order No. 787 grants the request of Essex Condominium and AOBA to withdraw its the Complaint lodged against Washington Gas Light Company and dismisses the Complaint with prejudice.
 

Summary of August 9th Open Meeting

The Public Service Commission of the District of Columbia approved two action items at its August 8, 2019 Open Meeting.

The matters include:

1. Formal Case No. 1144, In the Matter of the Potomac Electric Power Company’s Notice to Construct Two 230kV Underground Circuits from the Takoma Substation to the Rebuilt Harvard Substation, and from the Rebuilt Harvard Substation to the Rebuilt Champlain Substation. Order No. 20203 approves Phase I of the Potomac Electric Power Company’s (“Pepco”) Capital Grid Project with certain directives as outlined in this Order. Phase I excludes the proposed construction of the Mt. Vernon Substation. The Commission’s approval of Phase I of the Capital Grid Project does not depend upon any future assessment of whether the proposed Mt. Vernon Substation is needed, not needed, or can be deferred. The Commission will consider Pepco’s proposal to construct a new Mt. Vernon Substation separately in Phase II of its review.

2. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. Order No. 20204 adopts the procedural schedule proposed by the Office of the People’s Counsel, the Apartment and Office Building Association of Metropolitan Washington, and the District of Columbia Government, whereby, the Commission will review and consider Pepco’s traditional one year cost of service proposal alongside Pepco’s Application for approval of a Multiyear Rate Plan and Performance Incentive Mechanisms.
 

Summary of March 13th Open Meeting

The Public Service Commission of the District of Columbia (Commission) approved 11 actions items before the Commission at its March 13, 2019 Open Meeting.

The matters include:

1. Formal Case No. 712, In the Matter of the Investigation into the Public Service Commission’s Rules of Practice and Procedure. This Order delegates authority to the Office of Technical and Regulatory Analysis to approve Renewable Energy Portfolio Standard applications.

2. Formal Case No. 950, In the Matter of the Investigation into the Payment Center Operations of Verizon Washington, DC Inc. This Order modifies the requirements regarding Verizon’s Authorized Payment Locations as described in this Order.

3. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. The first Order grants Verizon’s Request for DC Universal Service Trust Fund Funding Application for the Fourth Quarter of 2018.

4. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. The second Order approves Verizon’s Application proposing its District of Columbia Universal Service Trust Fund 2019 surcharge. The 2019 surcharge tariff shall become effective upon publication of a Notice of Final Tariff in the D.C. Register.

5. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. The first Order reviews the Annual Report of the Utility Discount Program Education Working Group for Fiscal Year 2018 and grants the Motion to accept the report out of time.

7. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. The third Order approves DOEE’s Invoices for the First Quarter of Fiscal Year 2019.

8. PEPACR-2017-01 and PEPACR-2018-01, In the Matter of the Annual Consolidated Report of the Potomac Electric Power Company. This Order accepts Pepco’s 2017 and 2018 Annual Consolidated Reports.

9. RM40-2017-01, In the Matter of 15 DCMR Chapter 40 – District of Columbia Small Generator Interconnection Rules and Formal Case No. 1050, In the Matter of the Investigation of Implementation of Interconnection Standards in the District of Columbia. This Order approves Pepco’s amended Level 1 Interconnection Agreement Change Notice.

10.RPSR-2019-01, In the Matter of Electricity Supplier 2018 Compliance Report Form for the District of Columbia Renewable Energy Portfolio Standard. This Order adopts the Electricity Supplier 2018 Compliance Report Form for the District of Columbia Renewable Energy Portfolio Standard.

11.PEPEMMR2019-01, Potomac Electric Power Company’s Electric Market Monitoring Report. This Order grants Pepco’s Motion to Suspend and/or Modify the Annual Retail Electric Choice Report to the extent set forth in this Order.
 

Summary of February 27th Open Meeting

The Public Service Commission of the District of Columbia (Commission) approved two actions items before the Commission at its February 27, 2019 Open Meeting.

The matters include:

1. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia. This Order approves the Potomac Electric Power Company’s revised proposed retail rates, including the administrative charges, for Standard Offer Service (“SOS”) filed January 25, 2019. Pepco shall file a revised tariff setting forth the new retail rates for SOS within seven (7) calendar days of the date of this Order.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Distribution System for Increased Sustainability. This Order directs the Potomac Electric Power Company to have funds in the amount of $76,904.38 disbursed from the Modernizing the Energy Deliver System for Increased Sustainability (“MEDSIS”) Pilot Project Fund Subaccount, created as a condition of the approval of the PHI-Exelon Merger, to Smart Electric Power Alliance for the provision of consulting services for Phases 1 and 2 of the MEDSIS Initiative within 15 days of the date of this Order.
