Summary of January 26th Open Meeting

The Public Service Commission of the District of Columbia approved four Formal Case action items at its January 26, 2022, Open Meeting:
 
Formal Case Actions:

1. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order denies the Potomac Electric Power Company’s Application for Clarification of Order No. 21061.

2. Formal Case No. 1168, In the Matter of the Applications for Approval of Biennial Underground Infrastructure Improvement Projects Plans and Financing Orders — This Order, among other things, grants the Joint Application of the Potomac Electric Power Company and the District of Columbia Department of Transportation for Approval of the Third Biennial Underground Infrastructure Improvement Projects Plan and Financing Order Application.

3. RM29-2021-01, In the Matter of 15 DCMR Chapter 29 – Renewable Energy Portfolio Standard — This Order and Notice of Emergency Rulemaking adopts and extends, on an emergency basis, revisions to Subsection 2902.12 of Chapter 29, Renewable Energy Portfolio Standard of Title 15 - DCMR to no longer permit the "deemed approval" provision of the Rules. Additionally, applicants seeking amendments to a certified solar energy system’s capacity and/or orientation shall now be required to submit as-built construction drawings.

4. WGRORETR-2021-01, In the Matter of Washington Gas Light Company’s Report on Weather Normalized Jurisdictional Earned Return — This Order, among other things, denies Washington Gas Light Company’s Motion to Waive the filing of Quarterly Jurisdictional Earnings Reports.

The Public Service Commission of the District of Columbia approved three Formal Case action items at its January 12, 2022, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1057, In the Matter of Verizon Washington, D.C. Inc.’s Price Cap Plan 2007 for the Provision of Local Telecommunications Services in the District of Columbia – This Order, among other things, grants Verizon DC’s Motion for Waiver of Any Application or Approval Requirements to Withdraw Station Messaging Detail Service.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability – This Order directs Pepco to release $72,100.00 from the MEDSIS Pilot Project Fund Subaccount to Synapse Energy Economics, Inc., within 15 days from the date of this Order.

3. RM40-2020-01, In the Matter of 15 DCMR Chapter 40 – District of Columbia Small Generator Interconnection Rules and Formal Case No. 1050, In the Matter of the Investigation of Implementation of Interconnection Standards in the District of Columbia – This Order, among other things, holds in abeyance Pepco’s Application for Clarification and grants DOEE’s Application for Reconsideration of Order No. 20991.

1. Consumer Complaint No. 2021-9075256, In the Matter of Aneesa Salaam v. Washington Gas Light Company - This Order denies Washington Gas Light Company and the Office of the People’s Counsel’s Petitions for review and affirms the Hearing Officer’s August 2, 2021, Order.

The Public Service Commission of the District of Columbia approved six Formal Case action items at its December 8, 2021, Open Meeting:

Formal Case Actions:

1. Formal Case No. 712, In the Matter of the Investigation into the Public Service Commission’s Rules of Practice and Procedure - This Order establishes the simple interest rate of 0.12 percent, which regulated utilities in the District of Columbia shall pay to customers on deposits during the Calendar Year 2022.

2. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia - This Order approves the revised Calendar Year 2022 budget and assessment calculation for the District of Columbia Universal Service Trust Fund.

3. Formal Case No. 1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc - This Order grants the Application of AltaGas Ltd. and Washington Gas Light Company for Clarification and Modification of Order No. 20989 as described in this Order.

4. Formal Case No. 1156, In the Matter of the Application of the Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia - This Order, among other things, approves a new Master Meter Apartments (“MMA”) class rate design and MMA Billing Determinants for Calendar Year 2022.

5. Formal Case No. 1156 and Electric Tariff 2021-02, In the Matter of the Potomac Electric Power Company’s House of Worship and Non-Profit Customer Credit Tariff - This Order and Notice of Final Tariff (“Notice”) approves Pepco’s Houses of Worship and Non-Profit Human Services Organizations’ Demand Charge Credit tariff which will become effective publication of a Notice in the D.C. Register.

6. Formal Case No. 1160, In the Matter of the Development of Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201 (b) of the Clean Energy DC Omnibus Amendment Act - This Order grants DOEE’s Motion for Reconsideration or Modification of Order No. 21030 as described in this Order.

The Public Service Commission of the District of Columbia approved three Formal Case action items at its December 1, 2021, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1154, In the Matter of Washington Gas Light Company’s Application for Approval of PROJECTpipes 2 Plan - This Order grants WGL’s Application for Approval of Revision to Year 7 Annual Project List of the Accelerated Pipes Replacement Program.

2. Formal Case No. 1160, In the Matter of the Development of Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201 (b) of the Clean Energy DC Omnibus Amendment Act - This Order approves Applied Energy Group’s bid on WGL’s RFP for an Energy Efficiency and Demand Response Technical Potential Study.

3. RM7-2021-01, Freedom of Information Act Requests - This Notice of Final Rulemaking (“NOFR”) amends 15 DCMR Chapter 7, the Commission’s Freedom of Information Act Rules, effective upon publication of the NOFR in the D.C. Register.
 

Summary of November 17th Open Meeting

The Public Service Commission of the District of Columbia approved five Formal Case action items at its November 17, 2021, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability — This Order approves WGL’s (“Company”) System-Level Process Plan. WGL shall include in its Annual Report an attestation by the Company that appropriate access controls are in place to minimize the risk of unauthorized access to system data.

2. Formal Case No. 1134, In the Matter of the Investigation into the Procurement Cost Adjustment for Standard Offer Service — This Order approves the final report and recommendation filed on behalf of Pepco, OPC, and Commission Staff concerning the Commission’s investigation into Pepco’s Procurement Cost Adjustment.

3. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order grants the Joint Motion for Clarification of Order No. 20754.

4. TT00-5, In the Matter of Verizon Washington, DC Inc.’s Public Occupancy Surcharge General Regulations Tariff, P.S.C.-D.C. No. 201 — This Notice of Final Tariff approves Verizon’s Rights-of-Way Compliance Filing for 2021 which shall be effective upon publication in the D.C. Register.

5. Formal Case No. 712, in the Matter of the Investigation into the Public Service Commission’s Rules of Practice and Procedure. — This Order grants Pepco’s Request for Waiver of Commission Rule 304.1.
 

Summary of November 10th Open Meeting

The Public Service Commission of the District of Columbia approved two Formal Case action items at its November 10, 2021, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs — This Order denies Pepco’s Request for Reconsideration of Order No. 21012.

2. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order grants in part the Motion of AltaGas and WGL for an Enlargement of Time. AltaGas and WGL shall file the 5-Year Plan on December 15, 2021, and the 30-Year Plan on January 18, 2022.
 

Summary of October 27th Open Meeting

The Public Service Commission of the District of Columbia approved two Formal Case action items at its October 27, 2021, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order grants Pepco’s Motion for Clarification of Comment Periods. Stakeholders may file comments on individual Pepco filings within 60 days of the date of the filings.

2. Formal Case No. 1017, In the Matter of the Development and Designation of SOS Service in the District of Columbia and Formal Case No. 1155, In the Matter of the Application of Pepco for Approval of its Transportation Electrification Program — This Notice of Final Tariff (“Notice”) approves Pepco’s tariff amendments that updates the Company’s retail transmission rates consistent with the current FERC approved wholesale transmission rates. These amendments will become effective upon publication of this Notice in the D.C. Register.
 

Summary of October 20th Open Meeting

The Public Service Commission of the District of Columbia approved four Formal Case action items at its October 20, 2021, Open Meeting: 

Formal Case Actions:

1. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia This Order approves the calendar year 2022 budget and assessment calculation for the District of Columbia Universal Service Trust Fund. 

2. Formal Case No. 1148, In the Matter of the Investigation into the Establishment of Energy Efficiency and Energy Conservation Programs Targeted Towards Both Affordable Multifamily Units and Master Metered Multifamily Buildings Which Include Low and Limited Income Residents in the District of Columbia — This Order directs Pepco to release and disburse $33,292.00 from the Energy Efficiency and Energy Conservation Initiatives Fund escrow account for reimbursement of the incremental costs for the administration of the Deep Retrofit Program. 

3. Formal Case No. 1160, In the Matter of the Development of the Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201(B) of the Clean Energy DC Omnibus Amendment Act of 2018 This Order approves Pepco’s RFP for an Energy Efficiency and Demand Response Technical Potential Study. Pepco shall issue the RFP within five (5) business days of the date of this Order. 

4. Formal Case No. 1156, In the Matter of the Application of the Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia — This Order denies the Applications for Reconsideration filed by Pepco, OPC, AOBA, and GSA and clarifies various aspects of Order No. 20755 as described in this Order. 

Summary of October 6th Open Meeting

The Public Service Commission of the District of Columbia approved three Formal Case action items at its October 6, 2021, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1119, In the Matter of the Joint Application of Exelon Corporation, Pepco Holdings, Inc., Potomac Electric Power Company, Exelon Energy Delivery Company, LLC and New Special Purpose Entity, LLC for Authorization and Approval of Proposed Merger Transaction and Electric Tariff 2021-01, In the Matter of the Potomac Electric Power Company’s Customer Base Rate Credit Tariff Columbia — This Notice of Final Tariff (“Notice”) approves Pepco’s Customer Base Rate Credit tariff revision for its Schedule GS-3A customers becoming effective on or after the October 2021 billing cycle and officially upon publication of this Notice in the D.C. Register.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability — This Order directs Pepco to release $55,488.75 from the MEDSIS Pilot Project Fund Subaccount to Synapse Energy Economics, Inc., within 15 days from the date of this Order.

3. Formal Case No. 1160, In the Matter of the Development of the Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201(B) of the Clean Energy DC Omnibus Amendment Act of 2018 — This Order among other things, accepts the Energy Efficiency and Demand Response Metrics Working Group Report as filed and accepts the recommendations as modified in this Order.
