Summary of September 16th Open Commission Meeting

The Public Service Commission of the District of Columbia approved three Formal Case action items at its September 16, 2020, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia. This Order approves and adopts the SOS Working Group’s proposed WFRSA and RFP for the 2020-2021 SOS Solicitation. The SOS Working Group is directed to file a complete final copy with the Commission Secretary by October 5, 2020.

2. Formal Case No. 1165, In the Matter of the Petition for Implementation of Relief for the 202 Area Code. This Order approves the Petition of the North American Numbering Plan Administrator on behalf of the D.C. Telecommunications Industry for relief for the 202 area code and the 13-month implementation schedule proposed in the Petition.

3. OPC2020-02, Office of the People’s Counsel for the District of Columbia’s Motion to Compel Discovery Response from Washington Gas Light Company. This Order grants in part and denies in part OPC’s Motion to Compel Discovery Response and grants OPC’s Motion for Leave to Reply and Limited Reply. 
 

Summary of September 9th Open Commission Meeting

The Public Service Commission of the District of Columbia approved two Formal Case action items at its September 9, 2020, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1115, In the Matter of Washington Gas Light Company’s Request for Approval of a Revised Accelerated Pipe Replacement Plan and Formal Case No. 1154, In the Matter of the Application of Washington Gas Light Company for Approval of PROJECTpipes 2 Plan. This Order moves evidence into the record and establishes a procedural schedule for the PROJECTpipes 2 Plan. The Commission also extends, sua sponte, WGL’s PROJECTpipes 1 Plan and surcharge for an additional 90.

2. RM1-2020-01, et. al. – This Notice of Final Rulemaking adopts a “waiver of rules” provision in each of the respective chapters of Title 15 of the District of Columbia Municipal Regulations and will become effective upon publication in the D.C. Register.
 

Summary of August 20th Open Commission Meeting

The Public Service Commission of the District of Columbia approved four Formal Case action items at its August 20, 2020, Open Meeting:

Formal Case Actions:
 
1. Formal Case No. 1154, In the Matter of the Application of Washington Gas Light Company for Approval of PROJECTpipes 2 Plan. This Order determines that an evidentiary hearing in this proceeding is not warranted.

2. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. This Order accepts Pepco’s Supplemental Testimony and holds in abeyance the Joint Petitioners Motion to Dismiss the Multiyear/Enhanced Rate Plan Proposals and to Direct Withdrawal of Pepco’s Rate Case Application. The Commission also directs Pepco to convene a virtual Technical Conference to be held no later than September 15, 2020, to discuss Pepco’s corrected billing determinants errata.

3. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. This Order grants OPC’s request to reschedule the virtual community hearing date. The virtual community hearing date will now be conducted on September 29, 2020, starting at 2:00 p.m.

4. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the District Department of Energy and Environment’s Invoices for the Third Quarter FY 2020.
 

Summary of August 12th Open Commission Meeting

The Public Service Commission of the District of Columbia approved six Formal Case action items at its August 12, 2020, Open Meeting:

Formal Case Actions:

1. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. This Order grants Verizon DC’s Request for the DC Universal Service Trust Fund Funding Application for the Second Quarter of 2020.

2. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the Utility Discount Program Education Working Group’s proposed FY 2021 Consumer Education Program and Utility Discount Program Administrative Budget.

3. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability, and Formal Case No. 1155, In the Matter of the Application of the Potomac Electric Power Company for Approval of its Transportation Electrification Program. This Order approves Pepco’s tariff revisions to its Residential Service Plug-In Vehicle Charging Schedule. The tariff shall become effective upon publication of the Notice of Final Tariff in the D.C. Register.

4. Formal Case No. 1157, In the Matter of the Investigation Into Washington Gas Light Company’s Compliance with the Recommendations of the National Transportation Safety Board. This Order approves WGL’s Updated Implementation Plan addressing the National Transportation Safety Board’s safety recommendations and denies OPC’s recommendation for a separate investigation.

5. RM3-2018-01, In the Matter of the Investigation into the Public Service Commission’s Rules Governing Energy Meter Relocations. This Order denies Pepco’s Request for a Temporary Waiver of Commission Rules.

6. RM23-2020-2-G, Natural Gas; RM46-2020-01-E, Licensure of Electricity Suppliers; and RM47-2020- 01-G, Licensure of Natural Gas Suppliers. This Notice of Emergency Rulemaking grants the Commission authority to waive the provisions of Chapters 23, 46, and 47 that may relate to and may be necessary to protect the health, safety, and well-being of the District of Columbia residents in response to the COVID-19 global pandemic. 
 

Summary of August 5th Open Commission Meeting

The Public Service Commission of the District of Columbia approved six Formal Case action items at its August 5, 2020, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order accepts the recommendation of the Pilot Projects Working Group to exclude individuals from serving as members on the Pilot Projects Governance Board and opens a new docket designated exclusively for all Governance Board business.

2. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. This Order denies BWLDC’s Motion to Compel, grants Pepco’s Motion to File Untimely Response to the Motion to Compel and grants BWLDC’s Opposition to Pepco’s Motion.

3. RM9-2020-03, In the Matter of 15 DCMR Chapter 9 — Net Energy Metering. This Order adopts amendments to Chapter 9, Net Energy Metering which shall become effective upon publication of a Notice of Final Rulemaking in the D.C. Register.
 

Summary of July 29th Open Commission Meeting

The Public Service Commission of the District of Columbia approved six Formal Case action items at its July 29, 2020, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1154, In the Matter of Washington Gas Light Company’s Application for Approval of PROJECTpipes 2 Plan. This Order denies Washington Gas Light Company’s Motion to Strike the Sierra Club’s Direct Testimony and Exhibits filed on June 15, 2020.
 
The next three (3) matters are in Formal Case No. 1162, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service. 2. The first Order denies the Office of the Peoples Counsel’s (OPC’s) Motion to Compel filed June 5, 2020.
3. The next Order grants in part and denies in part OPC’s Motion to Compel filed June 17, 2020.
4. The last Order grants OPC’s Motion to Compel filed June 26, 2020. 

5. ASMT 2020, Assessments for Fiscal Year 2020. These Orders assess public utility companies, competitive local exchange carriers, competitive natural gas suppliers and competitive electric suppliers for their percentages of the Commission’s and OPC’s Fiscal Year 2020 appropriated budget as directed in the Orders.

6. GT00-2, In the Matter of Washington Gas Light Company’s Rights-of-Way Surcharge General Regulations Tariff, P.S.C.-D.C. No. 3. This Notice of Final Tariff (“Notice”) approves Washington Gas Light Company’s Rights-of-Way Fee Surcharge which shall become effective upon publication of this Notice in the D.C. Register.
 

Summary of July 15th Open Commission Meeting

The Public Service Commission of the District of Columbia approved one Formal Case action item at its July 15, 2020, Open Meeting:

Formal Case Action:

1. OPC2020-02-G, Office of the People’s Counsel for the District of Columbia’s Motion to Compel Discovery Response from Washington Gas Light Company. This Order grants the Retail Energy Supply Association’s request for an extension of time until July 17, 2020, to file comments in this proceeding.
 

Summary of July 8th Open Commission Meeting

The Public Service Commission of the District of Columbia approved one action item at its July 8, 2020, Open Meeting:

Formal Case Action: 

1. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. This Order denies the District of Columbia Government’s Motion for Relief in the Alternative and adopts the procedural schedule in Attachment A of this Order.
 

Summary of July 1st Open Commission Meeting

The Public Service Commission of the District of Columbia approved the following action item(s) at its July 1, 2020, Open Meeting:

Formal Case Actions: 

1. Formal Case No. 1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc. This Order directs WGL to supplement the Root Cause Analysis report within 60 days of the date of this Order; comments and reply comments are due within 30 and 45 days of this filing, respectively.

2. PEPPOR 2020-01, Purchase of Receivables. This Order approves Pepco’s Purchase of Receivables (“POR”) tariff. The POR tariff will become effective upon publication of a Notice of Final Tariff in the D.C. Register.

3. PEPRADR 2020-01, In the Matter of Potomac Electric Power Company’s Residential Aid Discount Compliance Reports and Filings and Formal Case No. 1120, In the Matter of the Investigation into the Structure and Application of Low- Income Assistance for Electricity Customers in the District of Columbia. This Notice of Final Tariff (“Notice”) approves Pepco’s Rider - Residential Aid Discount Surcharge Update which shall become effective upon publication of the Notice in the D.C. Register.

The Public Service Commission of the District of Columbia approved two action items at its June 17, 2020 Open Meeting. The matters include:

Formal Case Actions:

1. Formal Case No. 1156, the Order regarding Joint Emergency Motion to Strike and for Summary Judgment. Order No. 20368, denied the Joint Emergency Motion to Strike Pepco’s Surrebuttal Testimony Pertaining to the Company’s New MRP Proposal and for Summary Judgment on Pepco’s Multiyear Rate Plan Application.

2. Formal Case No. 1162, the Order regarding Motion to Extend Procedural Schedule.Order No. 20369, granted in part and denies in part the Office of the People’s Counsel for the District of District of Columbia and Joint Intervenors’ Motion to Extend Procedural Deadlines and to Clarify Order No. 20338, or, in the Alternative, Request for Limited Reconsideration.
