Summary of June 15th Open Meeting

The Public Service Commission of the District of Columbia approved six Formal Case action items at its June 15, 2022, Open Meeting:

Formal Case Action:
 
1. Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of Washington Gas Light Company, District of Columbia Division, In the District of Columbia and Formal Case No.1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc. — This Order grants the Office of the People’s Counsel’s Motion for Clarification of Order No. 21142.

2. Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of Washington Gas Light Company, District of Columbia Division, In the District of Columbia and Formal Case No.1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc. — This Order, among other things, accepts Washington Gas Light Company’s Natural Gas Quality of Service Standards Annual Report for Calendar Year 2021.

3. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia. — This Order approves Pepco’s Request for Proposal for an Independent Audit of Pepco’s Bill Stabilization Adjustment.

4. Formal Case No. 1169, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service. — This Order grants AOBA, GSA, the District of Columbia Government, Sierra Club, and DC Water’s Petitions to Intervene. The Commission also grants DC Water’s Motion to file its Petition to Intervene out of time.

5. WGPOR-2021-01, In the Matter of the Investigation into the Establishment of a Purchase of Receivables Program for Natural Gas Suppliers and Their Customers in the District of Columbia. — This Notice of Final Tariff (“Notice”) approves Washington Gas Light Company’s amendments to its Purchase of Receivables tariff, effective upon publication of this Notice in the D.C. Register.

6. OPC2021-01-G, The Office of the People’s Counsel for the District of Columbia’s Petition for Investigation into Washington Gas Light Company’s System Leak Reduction Practices & Transparency. — This Order denies, at this time, the Office of the People’s Counsel‘s Petition and Motion to Establish an Investigation into the Reasonableness, Safety, and Prudence of Washington Gas Light Company’s Handling of Natural Gas Leaks on its Distribution System.

The Public Service Commission of the District of Columbia approved two Formal Case action items at its June 1, 2022, Open Meeting:

Formal Case Action:

1.Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability, and Formal Case No. 1155, In the Matter of the Application of the Potomac Electric Power Company for Approval of Its Transportation Electrification Program —This Order, among other things, directs Pepco to file a tariff for electric vehicle charges implementing submetering in multi-dwelling units solely for electric vehicle parking spaces within 45 days from the date of this Order.

2.PEPRADR-2022-01, The Potomac Electric Power Company’s Residential Aid Discount Compliance Reports and Filings — This Order and Notice of Final Tariff (“Notice”) approves Pepco’s Rider -Residential Aid Discount Surcharge tariff effective upon publication of the Notice in the D.C. Register.

The Public Service Commission of the District of Columbia approved four Formal Case action items at its May 16, 2022, Open Meeting:

Formal Case Action:

1. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability —This Order directs Pepco to release $16,195.00 from the MEDSIS Pilot Project Fund Subaccount to Synapse Energy Economics, Inc., within 15 days from the date of this Order.

2. Formal Case 1160, In the Matter of the Development of Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201 (b) of the Clean Energy DC Omnibus Amendment Act of 2018 — This Order approves Applied Energy Group, Inc.’s bid on Pepco’s Request for Proposal for an Energy Efficiency and Demand Response Technical Potential Study.

3. Formal Case 1168, In the Matter of the Applications for Approval of Biennial Underground Infrastructure Improvement Projects Plans and Financing Orders — This Order approves Pepco’s Application for adjustments to set the Underground Project Charges until the next proposed adjustment is approved by the Commission.

4. RM46-2022-01-E, In the Matter of the Investigation into the Public Service Commission’s Rules Governing the Licensure and Bonding of Electric Suppliers in the District of Columbia and RM47-2022-01-G, In the Matter of the Investigation into the Public Service Commission’s Rules Governing the Licensure and Bonding of Natural Gas Suppliers and Natural Gas Consumer Protection Standards in the District of Columbia — This Notice of Final Rulemaking (“NOFR”) adopts amendments to Chapter 46, Licensure of Electricity Suppliers and Chapter 47, Licensure of Natural Gas Suppliers, of Title 15-DCMR, effective upon publication of the NOFR in the D.C. Register.

The Public Service Commission of the District of Columbia approved three Formal Case action items at its May 2, 2022, Open Meeting:

Formal Case Action:

1. Formal Case No. 1134, In the Matter of the Investigation into the Procurement Cost Adjustment for Standard Offer Service and Electric Tariff 2022-01, In the Matter of the Potomac Electric Power Company’s Annual Procurement Cost Adjustment Tariff, P.S.C.-D.C. No. 1 — This Notice of Final Tariff (“Notice”) approves Pepco’s Procurement Cost Adjustment rate calculation tariff effective upon publication of this Notice in the D.C. Register.

2. Formal Case No. 1168, In the Matter of the Applications for Approval of Biennial Underground Infrastructure Improvement Projects Plans and Financing Orders — This Order approves Pepco’s Request for Approval of Schedule Provisions Applying the True-up Mechanism to the Underground Rider.

3. Formal Case 1169, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service — This Order denies the Office of the People’s Counsel’s Motion to hold Washington Gas Light’s Rate Case in Abeyance as described in this Order.

The Public Service Commission of the District of Columbia approved three Formal Case action items at its April 20, 2022, Open Meeting:

Formal Case Actions:

1. Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of Washington Gas Light Company, District of Columbia Division, In the District of Columbia and Formal Case No. 1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc. — This Order grants Washington Gas Light Company’s Motion Requesting Permission to Resume Non-Payment Disconnections.

 
2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability — This Order directs the Customer Impact Working Group to file a report resolving the issues regarding Pepco’s Connect My Data implementation as described in this Order.
 
3. Formal Case Nos. EA04-4, et.al., In the Matter of the Petition of NRG Energy, Inc. for a Declaratory Judgment or, Alternatively, for a Waiver and for Expedited Consideration — This Order grants the request of NRG Energy, Inc., and its retail supplier affiliates in the District of Columbia to permit a single representative of the affiliates to take and complete one test from the Electricity Supplier Workshop.
 

Summary of April 6th Open Meeting

The Public Service Commission of the District of Columbia approved three Formal Case action items at its April 6, 2022, Open Meeting:

Formal Case Actions:

1. GD-2021-01-E, In the Matter of the Office of the People’s Counsel’s Petition for Formal Investigation into the Prudence of Pepco’s Construction Practices and the Justness and Reasonableness of Construction-related Costs — This Order denies the Office of the People’s Counsel’s Petition for a Formal Investigation into the Prudence of Pepco’s Construction Practices.

2. GD-2022-01-E, In the Matter of the Complaint and Petition for an Investigation into Pepco’s Community Renewable Energy Facility Practices — This Order grants Pepco’s Motion for an Enlargement of Time to Answer. Pepco is directed to file its Answer no later than May 9, 2022.

3. RM9-2022-01-E, Net Energy Metering — This Notice of Final Rulemaking (“NOFR”) adopts amendments to Chapter 9 of Title 15-DCMR, Net Energy Metering Rules effective upon publication of the NOFR in the D.C. Register.
 

Summary of March 23rd Open Meeting

The Public Service Commission of the District of Columbia approved three Formal Case action items at its March 23, 2022, Open Meeting:

1. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia — This Order, among other things, approves Pepco’s proposed retail rates, including the administrative charges, for Standard Offer Service.

2. RM29-2021-01, In the Matter of 15 DCMR Chapter 29 — Renewable Energy Portfolio Standard — This Order and Notice of Final Rulemaking (“NOFR”) adopts amendments to Chapter 29 of Title 15-DCMR, Renewable Energy Portfolio Standard Rules effective upon publication of the NOFR in the D.C. Register.

3. RM36-2020-02, Electric Quality of Service Standards — This Order and Notice of Final Rulemaking (“NOFR”) adopts amendments to Chapter 36 of Title 15-DCMR, Electricity Quality of Service Standards Rules effective upon publication of the NOFR in the D.C. Register.
 

Summary of March 9th Open Meeting

The Public Service Commission of the District of Columbia approved five Formal Case action items at its March 9, 2022, Open Meeting:

Formal Case Actions:

1. Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of Washington Gas Light Company, District of Columbia Division, In the District of Columbia and Formal Case No. 1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc. — This Order grants in part and denies in part WGL’s Motion for Clarification of Order No. 21108 as described in this Order.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability — This Order directs Pepco to release $52,690.00 from the MEDSIS Pilot Project Fund Subaccount to Synapse Energy Economics, Inc., within 15 days from the date of this Order.

3. Formal Case No. 1130 and Formal Case No. 1155, In the Matter of the Application of the Potomac Electric Power Company for Approval of its Transportation Electrification Program — This Notice of Final Tariff approves Pepco’s update to its Plug-in Vehicle – Green Rider which will become effective upon publication in the D.C. Register.

4. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order grants in part and denies in part the Joint Parties’ Confidential/Proprietary Information Determination Request and directs the General Counsel to convene a conference with the parties to attempt to reach a consensus on what additional information can be released. 
 

Summary of February 22nd Open Meeting

The Public Service Commission of the District of Columbia approved four Formal Case action items at its February 22, 2022, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs — This Order reviews the Annual Report of the Utility Discount Program Education Working Group and directs the Working Group to continue its efforts to increase Utility Discount Program participation through the Consumer Education Program and other initiatives.

2. Formal Case No. 1154, In the Matter of Washington Gas Light Company’s Application for Approval of PROJECTpipes 2 Plan — This Order denies the Environmental Defense Fund’s and the Office of the People’s Counsel’s Motions to Compel and directs Commission Staff to convene a technical conference within 60 days consistent with this Order.

3. PEPIA-2021-01-1, Potomac Electric Power Company’s Request for Approval of an Independent Accountant — This Order, among other things, grants Pepco’s request for approval of an independent accountant.

4. RM27-2022-01, In the Matter of the Commission’s Investigation into the Rules Governing Local Exchange Carrier Quality of Service Standards for the District — This Order adopts amendments to Chapter 27, Regulation of Telecommunications Service Providers of Title 15 of the DCMR which shall become effective upon publication of a Notice of Final Rulemaking in the D.C. Register.

The Public Service Commission of th   District of Columbia approved four Formal Case action items 
at its February 9, 2022, Open Meeting:

Formal Case Actions:

1. Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of  Washington Gas Light Company, District of Columbia Division, In the District of Columbia and Formal  Case No. 1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc — This Order  clarifies the conditions under which WGL may resume its disconnection activities that were paused  by Order No. 21017.  WGL shall show compliance with 15 DCMR §§ 3704.6 and 3704.8 for the first  quarter of 2022, before filing a motion seeking to resume disconnection activities.

2. Formal Case No. 1148, In the Matter of the Investigation into the Establishment of Energy  Efficiency and Energy Conservation Programs Targeted Towards Both Affordable Multifamily Units and  Master Metered Multifamily Buildings Which Include Low- and Limited-Income Residents in the  District of Columbia — This Order directs Pepco (“Company”) to disburse $81,267.00 from the Company’s EEEC Fund escrow account for the Company’s incremental costs for the  third and fourth quarters of 2021.

3. Formal Case No. 1168,  In the Matter of the Applications for Approval of Biennial Underground 
Infrastructure Improvement Projects Plans and Financing Orders — This Order directs Pepco  (“Company”) to file a formal written pleading should the Company seek to recover any excess amount 
spent over the $250 million designated in the Undergrounding Act in a future base rate case.   Interested persons shall have 20 days from the date of Pepco’s filing to file an objection.

4. Consumer Complaint No. 9075256, In the Matter of Aneesa Salaam v. Washington Gas Light Company  — This Order denies OPC’s Application for Reconsideration of Commission Order No.
21081.
