Summary of October 12th Open Meeting

The Public Service Commission of the District of Columbia approved one Formal Case action item at its October 12, 2022, Open Meeting:
 
1. Formal Case No. 1160, In the Matter of the Development of Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201 (B) of the Clean Energy DC Omnibus Amendment Act of 2018 — After considering the pleadings, and in lieu of tolling, Order No. 21417 is rescinded and a revised order to provide more clarity will be issued within 30 days.

The Public Service Commission of the District of Columbia approved three Formal Case action items at its October 5, 2022, Open Meeting:
 
1. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability — This Order directs Pepco to release $24,625.00 from the MEDSIS Fund Subaccount to Synapse Energy Economics, Inc., within 15 days from the date of this Order.
 
2. Formal Case No. 1154, In the Matter of Washington Gas Light Company’s Application for Approval of PROJECTpipes 2 Plan — This Order approves Washington Gas Light Company’s (“Company”) Application for Approval of Revisions to the Company’s Year 8 Annual Project List
of the Accelerated Pipes Replacement Plan.
 
3. Formal Case No. 1164, In the Matter of an Inquiry into the Impacts of the COVID-19 Pandemic on District Utilities and Consumers — This Order, among other things, extends Washington Gas Light Company’s (“Company”) Arrearage Management Program (AMP) for two (2) years and allows the Company to automatically enroll customers into the AMP program.

The Public Service Commission of the District of Columbia approved four Formal Case action items at
its September 21, 2022, Open Meeting:

1. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia — This Notice of Final Tariff (“Notice”) approves Pepco’s (“Company”) proposed tariff amendment that updates the Company’s retail transmission rates, effective upon publication of this Notice in the D.C. Register.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability — This Order grants in part and denies in part Mission: data Coalition’s Application for Reconsideration of Order No. 21412 and Motion for Leave to File Comments regarding billing data as described in this Order.

3. The next matter is also in Formal Case No. 1130 and Formal Case No. 1155, In the Matter of the Application of the Potomac Electric Power Company for Approval of its Transportation Electrification Program. This Notice of Final Tariff (“Notice”) approves Pepco’s proposed update to its General Terms and Conditions regarding Electric Vehicle charging stations, effective upon publication of this Notice in the D.C. Register.

4. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia — This Order approves Atrium Economics to conduct an audit of Pepco’s Bill Stabilization Adjustment.

The Public Service Commission of the District of Columbia approved five Formal Case action items at its September 14, 2022, Open Meeting:
 
1. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia - This Order approves and adopts the SOS Working Group’s proposed WFRSA and RFP for the 2022-2023 SOS Solicitation. The SOS Working Group is directed to file a complete final copy with the Commission Secretary by October 3, 2022.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability, and Formal Case No. 1155, In the Matter of the Application of the Potomac Electric Power Company for Approval of its Transportation Electrification Program - This Notice of Final Tariff (“Notice”) approves Pepco’s proposed update to its Rider PIV-Green Tariff, effective upon publication of this Notice in the D.C. Register.

3. Formal Case No. 1163, In the Matter of the Investigation into the Regulatory Framework of Microgrids in the District of Columbia — This Order denies DOEE’s Motion for Reconsideration and Clarification of Order No. 21172 and grants Pepco’s Application to modify Order No. 21172. Pepco is directed to update the current Standby Service to accommodate a distributed energy resources focus on microgrids on or before March 1, 2023.

4. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order grants ChargePoint, Inc.’s Petition for Leave to Intervene and Motion for Special Appearance of Counsel.

Summary of August 10th Open Meeting

The Public Service Commission of the District of Columbia approved three Formal Case action items at its August 10, 2022, Open Meeting:

Formal Case Actions:

1. Formal Case No. 1156, In the Matter of the Application of Potomac Electric Power Company for Authority to Implement a Multiyear Rate Plan for Electric Distribution Service in the District of Columbia — This Order, among other things, accepts the Second Performance Incentive Mechanism (“PIM”) Working Group Report. The Commission directs Pepco to compile and publish actual performance data for both Calendar Years 2020 and 2021 for four performance tracking metrics (“PTM”) on a dashboard-style website. The Commission reconvenes the PIMs Working Group to make recommendations for annual performance level baseline targets for the next five years. In addition, the Commission directs the PIMs Working Group to make recommendations on the future conversion of the four PTMs into fully functioning PIMs.

2. Formal Case No. 1160, In the Matter of the Development of Metrics for Electric Company and Gas Company Energy Efficiency and Demand Response Programs Pursuant to Section 201 (b) of the Clean Energy DC Omnibus Amendment Act of 2018 — This Order grants in part Pepco’s Application to Approve Three-Year Energy Efficiency and Demand Response Program. The Commission approves a modified set of programs, including the following as set forth in Pepco’s Application: (1) Efficient Products Program; (2) Quick Home Energy Check-Up Program; (3) Residential Behavior-Based Program; (4) LMI Home Energy Program; (5) Commercial Behavior-Based Program; (6) Midstream Program; (7) Existing Buildings Program; and (8) Low- and Moderate-Income Community Pilots. The Commission also approves the Small Business Program but modifies the approved program costs. Pepco to implement the approved modified energy efficiency and demand response programs beginning on January 1, 2023, and continuing for three years thereafter, and may recover approved program costs through Rider EEDR.

3. Formal Case No. 1169, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service — This Order denies AOBA’s  motion requesting that the Commission either reject or hold in Abeyance the Rate Increase Application of WGL and grants AOBA’s Supplemental Testimony Motion regarding affiliate services to WGL.  The Commission also directs WGL to file supplemental testimony on the IRS private letter ruling.  The Commission also grants in part and denies in part OPC’s Motion for Partial Summary Judgment and Related Relief, the Sierra Club’s Motion to Hold in Abeyance, and the Motion of OPC to Reject WGL's Request for a Condensed Procedural Schedule.  The Commission does not designate specific issues for this proceeding and defers identification of issues of material fact in dispute until after all testimony has been filed.  The Commission declines to appoint a Settlement Officer in this proceeding.  Finally, the Commission adopts a revised procedural schedule.

Formal Case Action:

1. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia — This Order approves Pepco’s 15-year Renewable Energy Purchase Agreement with Invenergy for renewable energy to serve a target quantity of 5% of the Standard Offer Service electricity supply load for the District of Columbia beginning in December 2024.

The Public Service Commission of the District of Columbia approved four Formal Case action items at
its July 27, 2022, Open Meeting:

1. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery
System for Increased Sustainability — This Order directs Pepco to release $20,555.00 from the
MEDSIS Fund Subaccount to Synapse Energy Economics, Inc., within 15 days from the date of this
Order.

2. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery
System for Increased Sustainability — This Order, among other things, reviews the Customer Impact
Working Group Green Button 60-Day report and directs Pepco to provide further information
pursuant to Order No. 21141. The Order also adopts the definition of “best available data” to be used
in developing the District of Columbia’s Green Button CMD platform.

3. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate
Change Proposals — This Order grants in part and denies in part the Joint Motion for Abeyance and
Request for Expedited Ruling. The Commission revises the deadlines for briefs and directs parties
and interested stakeholders to file briefs within 60 days from the date of this Order. Reply briefs are
due 30 days after the initial briefs are filed.
 
4. ASMT 2022, Assessments for Fiscal Year 2022 — These Orders assess public utility companies,
competitive local exchange carriers, competitive natural gas suppliers, and competitive electric
suppliers for their percentage contributions of the Commission’s and the Office of Peoples Counsel’s
Fiscal Year 2022 appropriated budget.

1. Formal Case No. 1148, In the Matter of the Investigation into the Establishment of Energy Efficiency and Energy Conservation Programs Targeted Towards Both Affordable Multifamily Units and Master Metered Multifamily Buildings Which Include Low- and Limited-Income Residents in the District of Columbia — This Order directs Pepco (“Company”) to disburse $36,298.00 from the Company’s EEEC Fund escrow account for reimbursement of the Company’s incremental costs for the first quarter of 2022.

2. Formal Case No. 1167, In the Matter of the Implementation of Electric and Natural Gas Climate Change Proposals — This Order grants EVgo Services, LLC’s Petition for Leave to Intervene.

2. Formal Case No. 1170, In the Matter of the Application of Potomac Electric Power Company for a Certificate of Authority to Issue Debt Securities. — This Order approves Pepco’s (“Company”) Application for a certificate authorizing the Company to issue and sell debt securities.

3. PEPPOR-2022-01, Purchase of Receivables. — This Notice of Final Tariff (“Notice”) approves Pepco’s proposed Tariff amending the Purchase of Receivables (POR) Tariff and Supplier Discount Rate, effective upon publication of this Notice in the D.C. Register

4. GD-2022-01-E, In the Matter of the Complaint and Petition for an Investigation into Potomac Electric Power Company’s Community Renewable Energy Facility Practices and Formal Case No. 1171, In the Matter of the Investigation into Community Renewable Energy Facility Practices in the District. — This Order, among other things, grants the Office of the People’s Counsel of the District of Columbia Government’s Petition for an Investigation into Pepco’s Community Renewable Energy Facility practices.
