Open Meeting Summaries

The Public Service Commission of the District of Columbia (Commission) approved six actions items before the Commission at its January 9, 2019 Open Meeting.

The matters include:

1. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the District Department of Energy and Environment’s Invoices for the Fourth Quarter of Fiscal Year 2018 for the payment of UDP administrative expenses.

2. Formal Case No. 1137, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Rates and Charges for Gas Service; and GT2017-02, In the Matter of the Application of Washington Gas Light Company for Authority to Add Rate Schedule No. 7. This Order approves the Application of Washington Gas to amend its Rate Schedule No. 7, High Load Factor Rate Proposal for Combined Heat and Power and Distributed Generation facilities in the District of Columbia.

3. RM1-2018-01, In the Matter of the Commission’s Investigation into the Public Service Commission’s Rules of Practice and Procedure. This Order adopts final rules amending Chapter 1, “Public Service Commission Rules of Practice and Procedure” of Title 15 of the District of Columbia Municipal Regulations.

4. RM6-2018-01, In the Matter of the Commission’s Investigation into the Rules Regarding Pay Telephones. This Order adopts final rules amending Chapter 6, “Pay Telephones” of Title 15 of the District of Columbia Municipal Regulations.

5. RM27-2014-01, In the Matter of the Commission’s Investigation into the Rules Governing Local Exchange Carrier Quality of Service Standards for the District. This Order adopts final rules amending Chapter 27, “Regulation of Telecommunications Service Providers” of Title 15 of the District of Columbia Municipal Regulations.

6. RM40-2017-01, In the Matter of 15 DCMR Chapter 40 – District of Columbia Small Generator Interconnection Rules and Formal Case No. 1050, In the Matter of the Investigation of Implementation of Interconnection Standards in the District of Columbia. This Order adopts final rules amending Chapter 40, “District of Columbia Small Generator Interconnection Rules” of Title 15 of the District of Columbia Municipal Regulations. 
 

The Public Service Commission of the District of Columbia (Commission) approved eight actions items before the Commission at its December 4, 2018 Open Meeting.

The matters include:

1. Formal Case No. 712, In the Matter of the Investigation into the Public Service Commission’s Rules of Practice and Procedure. This Order delegates authority to the Office of the General Counsel to issue orders approving Consumer Pamphlets as required by Commission rules.

2. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. This Order grants Verizon Washington, DC Inc.’s (“Verizon DC”) Request for DC Universal Service Trust Fund (“DC USTF”) Funding Application for the Third Quarter of 2018 for the provision of Lifeline telephone service to low-income District of Columbia customers. The Commission directs the DC USTF Administrator to reimburse Verizon DC for the $12,486.50 requested by Verizon DC for the Third Quarter of 2018 within 15 days of the date of this Order.

3. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia. This Order grants Sierra Club’s Petition to Intervene and accepts its comments for the record.

4. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order grants the unopposed Motion of the Utility Discount Program Education Working Group to Modify the FY 2019 Consumer Education Program Plan.

5. Formal Case No. 1142, In the Matter of the Merger of AltaGas Ltd. and WGL Holdings, Inc. This Order denies the Joint Motion of the Office of the People’s Counsel and the District Government Requesting the Commission Clarify that AltaGas-Washington Gas’s Merger Condition No. 54 requires an examination of the Impact of the District’s Environmental Policies on the Costs and Benefits of Accelerating the PROJECTpipes Program. Even though the Commission declines to direct Washington Gas to modify its statement of work drafted pursuant to Term No. 54 to include an evaluation of the effect of the District of Columbia’s environmental policies on the possible acceleration of PROJECTpipes, the Commission expects that consideration of environmental factors will be included in the final cost benefit analysis filed with the Commission.

6. RM3-2014-01, Consumer Rights and Responsibilities and Formal Case No. 712, In the Matter of the Investigation into the Public Service Commission’s Rules of Practice and Procedure. This Order adopts final rules amending Chapter 3, “Consumer Rights and Responsibilities” of Title 15 of the District of Columbia Municipal Regulations. The rules in Attachment A of this Order shall become effective upon publication of the Notice of Final Rulemaking in the D.C. Register.

7. RM29-2018-01, In the Matter of 15 DCMR Chapter 29-Renewable Energy Portfolio Standard. This Order adopts final rules amending Chapter 29, “Renewable Energy Portfolio Standard”, of Title 15 of the District of Columbia Municipal Regulations. The rules in Attachment A of this Order shall become effective upon publication of the Notice of Final Rulemaking in the D.C. Register. 

8. RM41-2017-01, District of Columbia Standard Offer Service Rules. This Order adopts final rules amending Chapter 41, “Standard Offer Service Rules” of Title 15 of the District of Columbia Municipal Regulations. The rules in Attachment A of this Order shall become effective nine (9) months from the publication of the Notice of Final Rulemaking in the D.C. Register. 
 

The Public Service Commission of the District of Columbia approved fourteen action items at its November 6, 2019 Open Meeting.

The matters include:

1. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. Order No. 988 approves the 2020 calendar year District of Columbia Universal Service Trust Fund budget.

2. Formal Case No. 1115, In the Matter of the Application of Washington Gas Light Company’s Request for Approval of a Revised Accelerated Pipeline Replacement Program; Formal Case No. 1142, In the Matter of the Merger of AltaGas, Ltd. and WGL Holdings, Inc.; and Formal Case No. 1154, Washington Gas Light Company’s Application for Approval of PROJECTpipes 2 Plan. Order No. 1115 grants the Non-Unanimous Joint Motion for Enlargement of Time to File Settlement Conference Report. The Settlement Conference Report shall be filed no later than December 13, 2019. If a settlement cannot be reached by that time, the Commission directs the parties to submit a consensus procedural schedule by that same date, December 13, 2019.

3. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. Order No. 1130 directs Pepco to have funds in the amount of $12,345.65 released from the MEDSIS Fund Subaccount to Smart Electric Power Alliance within 15 days of the date of this Order.

4. Formal Case No. 1142, In the Matter of the Merger of AltaGas, Ltd. and WGL Holdings, Inc. Order No. 1142 approves WGL’s Term No. 3 Plan as directed by this Order and grants the National Consumer Law Center’s Motion to Enlarge Time for Filing Comment on Plan to Implement Commitment No. 3.

5. Formal Case No. 1142, In the Matter of the Merger of AltaGas, Ltd. and WGL Holdings, Inc. Order No. 1142 conditionally accepts AltaGas’ Term No. 5 Plan as directed by this Order.

6. Formal Case No. 1148, In the Matter of the Investigation into the Establishment of Energy Efficiency and Energy Conservation Programs Targeted Towards Both Affordable Multifamily Units and Master Metered Multifamily Buildings Which Include Low- and Limited-Income Residents in the District of Columbia. Order No. 1148 designates OPC, DOEE, the National Consumer Law Center, as well as Commission Staff to the Energy Efficiency and Energy Conservation Task Force.

7. Formal Case No. 1158, In the Matter of the Application of Washington Gas Light Company for a Certificate of Authority Authorizing it to Issue Debt Securities. Order No. 1158 approves WGL’s (“Company”) Application for a certificate authorizing the Company to issue and sell debt securities and preferred stock.\ Commission Open Meeting Summary

8. Formal Case No. 1159, In the Matter of Applications for Approval of Biennial Underground Infrastructure Improvement Projects Plans and Financing Orders. Order No. 1159 grants the petitions to intervene of WGL, AOBA, and the Baltimore Washington Construction & Public Employees Laborers’ District Council.

9. PEPRAD 2019-01, In the Matter of Potomac Electric Power Company’s Residential Aid Discount Compliance Reports and Filings and Formal Case No. 1120, In the Matter of the Investigation into the Structure and Application of Low-Income Assistance for Electricity Customers in the District of Columbia. This Notice of Final Tariff approves Pepco’s Revised Residential Aid Discount Surcharge. The Surcharge will become effective upon publication of this Notice in the D.C. Register.

10.RM41-2017-01, In the Matter of 15 DCMR Chapter 41- District of Columbia Standard Offer Service Rules. Order RM41-2017-01 grants Pepco’s request for a waiver of the implementation date of Section 4105.9 of Title 15 of the DCMR as directed by this Order.

11.RM37-2017-01, Natural Gas Quality of Service Standards and Reliability Performance and Formal Case No. 977, In the Matter of the Investigation into the Quality of Service of Washington Gas Light Company, District of Columbia Division, in the District of Columbia. Order RM37-2017-01 adopts final amendments to the Natural Gas Quality of Service Standards and Reliability Performance Rules in Chapter 37 of Title 15 of the DCMR. The amendments will become effective upon publication of a Notice of Final Rulemaking in the D.C. Register.

12.General Docket 2019-02, Decertification of Renewable Generating Facilities Submitted by Greenwalt Solar. This Order decertifies eight (8) certified generation facilities of Greenwalt, filed by Greenwalt, effective November 18, 2019, unless Greenwalt Solar presents evidence within 10 days from the date of this Order why the eight (8) facilities should not be decertified.

13.RM41-2019-01, In the Matter of 15 DCMR Chapter 41-District of Columbia Standard Offer Service Rules. Order RM41-2019-01 Notice of Final Rulemaking adopts amendments to, the Standard Offer Service Rules in Chapter 41 of Title 15 of the DCMR. The amendments will become effective upon publication of this Notice in the D.C. Register.

14.Formal Case No. 787, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service. Order No. 787 grants the request of Essex Condominium and AOBA to withdraw its the Complaint lodged against Washington Gas Light Company and dismisses the Complaint with prejudice. 
 

The Public Service Commission of the District of Columbia (Commission) approved five actions items before the Commission at its October 17, 2018 Open Meeting.

The matters include: 

1. Formal Case No. 1119, In the Matter of the Joint Application of Exelon Corporation, Pepco Holdings, Inc., Potomac Electric Power Company, Exelon Energy Delivery Company, LLC and New Special Purpose Entity, LLC for Authorization and Approval of Proposed Merger Transaction. This Order grants the Motion of the Office of the People’s Counsel for the District of Columbia (“OPC”) for Leave to Comment on Exelon’s Ring Fencing Report; accepts OPC’s Comments for consideration; and denies OPC’s request to grant the recommendations included therein. The Commission further directs that the Potomac Electric Power Company (“Pepco”) report to the Commission if Pepco is put on negative outlook or is downgraded below its current bond ratings by any of the major credit rating agencies within 7 days of such action.

2. Formal Case No. 1119, In the Matter of the Joint Application of Exelon Corporation, Pepco Holdings, Inc., Potomac Electric Power Company, Exelon Energy Delivery Company, LLC and New Special Purpose Entity, LLC for Authorization and Approval of Proposed Merger Transaction; Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia; and PEPPOR, Potomac Electric Power Company’s Purchase of Receivables Program. This Order grants the Potomac Electric Power Company’s (“Pepco”) Motion for Approval to Recover Costs Related to Forgiven Arrearages. Additionally, Pepco, in consultation with the AMP Working Group, is directed to prepare an updated Arrearage Management Program (“AMP”) implementation plan and separarate AMP cost estimate to be filed with the Commission in not less than 45 days from the date of this Order.

3. Formal Case No. 1140, In the Matter of the Investigation into the Establishment of a Purchase of Receivables Program for Natural Gas Suppliers and Their Customers in the District of Columbia. This Order directs Washington Gas Light Company (“WGL” or “Company”) to finalize the implementation of its Purchase of Receivables (“POR”) program consistent with this Order and file updated discount rates, an associated tariff, and implementation schedule within 15 days of the date of this Order. The Commission rejects WGL and the Retail Energy Supply Association’s request to recover the additional $300,000 POR implementation costs in WGL’s base rates.

4. Formal Case No. 1151, In the Matter of the Impact of the Tax Cuts and Jobs Act of 2017 on the Existing Distribution Service Rates and Charges for Potomac Electric Power Company and Washington Gas Light Company. This Order grants the Joint Proposal of Washington Gas Light Company (“WGL”), the Office of People’s Counsel for the District of Columbia, the Apartment and Office Building Association of Metropolitan Washington, and the Small Business Utility Advocates for a One-Time Bill Credit of $5,101,325. 2 WGL is directed to file a Notice with the Commission once its regulatory liability balance(s) associated with the 2017 Tax Act have been fully returned to its customers in accordance with the Joint Proposal. This Notice shall depict the amount of the one-time bill credit actually provided to, and the revenue actually received thereby from, each customer class. The Notice shall also provide a plan for a true-up of any material difference between the credit amount contained in the Joint Proposal and the actual amount credited to customers.

5. Formal Case No. 1153, In the Matter of the Investigation into the Status of Walter Reed’s Electric Distribution System. This Order grants the Petition of the Potomac Electric Power Company (“Pepco”) for an Investigation to Determine the Jurisdiction of the Public Service Commission of the District of Columbia to Regulate the Electric Distribution of Electricity to Retail Customers at The Parks at Walter Reed and hereby opens an investigation to determine whether the operation of Walter Reed’s Redevelopment Site electric distribution system is subject to regulation by the Commission as a public utility or by any alternative means designed to reasonably promote the public interest, preserve the public health, and protect customers. The Commission also grants the Petitions to Intervene of TPWR Developer, LLC and WGL Energy Services, Inc. and invites any other person with a substantial interest in this matter to seek to intervene within 10 days from the date of this Order.
 

The Public Service Commission of the District of Columbia (Commission) approved two actions items before the Commission at its October 3, 2018 Open Meeting.

The matters include:

1. Formal Case No. 712, In the Matter of the Investigation into the Public Service Commission’s Rules of Practice and Procedure. This Order grants authority to the Office of the General Counsel to issue orders on Applications of Competitive Local Exchange Carriers for Approval of Transfer of Control or Corporate Reorganization.

2. WGIA 2018-01, In the Matter of Washington Gas Light Company’s Request for Approval of Independent Accountant. This Order grants Washington Gas Light Company’s (“WGL”) request for approval of an independent accountant, Ernst & Young, to conduct a limited engagement review and prepare a report pursuant to Chapter 39 of the Commission’s Regulations regarding WGL affiliate transactions for the 12 months ending September 30, 2018. WGL is directed to file with the Commission a copy of its engagement letter with Ernst & Young upon execution by both parties. WGL is further directed to file the limited engagement report on or before March 1, 2019. 
 

The Public Service Commission of the District of Columbia (Commission) approved 13 actions items before the Commission at its September 19, 2018 Open Meeting.

The matters include:

1. Formal Case No. 950, In the Matter of the Investigation into the Payment Center Operations of VerizonWashington, D.C., Inc., and VAPLR2018-01, Annual Report of Authorized Payment Location. This Order grants Verizon Washington, DC Inc.’s (“Verizon DC”) Motion to File Notification of the Closing of Authorized Payment Locations with the Commission Out of Time and finds Verizon DC’s request to waive the requirement that Verizon DC have an Authorized Payment Location in Ward 5 moot since Verizon DC has found a new APL in Ward 5.

2. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. This Order grants Verizon Washington, DC Inc.’s (“Verizon DC”) Request for DC Universal Service Trust Fund (“DC USTF”) Funding Application for the Second Quarter of 2018 for the provision of Lifeline telephone service to low-income District of Columbia customers. The Commission directs the DC USTF Administrator to reimburse Verizon DC $12,548.33 for the Second Quarter of 2018 within 15 days of the date of this Order.

3. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia. This Order approves and adopts the Standard Offer Service (“SOS”) Working Group’s proposed Wholesale Full Requirements Service Agreement (“WFRSA”) and Request for Proposals (“RFP”) for the 2018 - 2019 SOS Solicitation as modified by this Order. This Order also directs the SOS Working Group to file a complete final copy of the WFRSA and RFP for the 2018 - 2019 SOS Solicitation with the Commission Secretary by October 3, 2018.

4. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the District Department of Energy and Environment’s (“DOEE”) Invoices for the Third Quarter of Fiscal Year 2018 for the payment of Utility Discount Program administrative expenses. The District of Columbia Universal Service Trust Fund is directed to pay $5,359.71; Potomac Electric Power Company is directed to pay $32,228.63; Washington Gas Light Company is directed to pay $32,187.55; and DC Water is directed to pay $32,251.11 to DOEE within 15 days of the date of this Order.

5. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order denies as moot the District of Columbia Department of Energy and Environment’s Motion for Limited Engagement of Consultants to Provide a Roadmap in Formal Case No. 1130.

6. Formal Case No. 1144, In the Matter of the Potomac Electric Power Company’s Notice to Construct Two 230 kV Underground Circuits from the Takoma Substation to the Rebuilt Harvard Substation and from the Rebuilt Harvard Substation to the Rebuilt Champlain Substation. This Order denies the Petitions to Intervene filed by the District of Columbia Government, the Apartment and Office Building Association of Metropolitan Washington, the Baltimore-Washington Construction and Public Employees Laborers’ District Council, and Solar United Neighbors of D.C. at this time. 

7. Formal Case No. TA 06-5, In the Matter of the Notification of Transfer of Control of Mitel Cloud Services, Inc. to Mitel Networks, Inc. This Order accepts the Notification of Mitel Networks Corporation, Mitel US Holdings, Inc., Mitel Delaware, Inc., Mitel Networks, Inc., formerly ShoreTel, Inc. and Mitel Cloud Services, Inc., of the transfer of control of Mitel Cloud Services, Inc. from Mitel Delaware, Inc. to Mitel Networks, Inc. Further, the Commission dismisses review of the Notification for lack of Commission jurisdiction.

8. Formal Case No. TA 06-5, In the Matter of the Joint Application of MLN TopCo Ltd., Mitel Networks Corporation, and Mitel Cloud Services, Inc. f/k/a Mitel NetSolutions, Inc. for Approval to Transfer Control of Mitel Cloud Services, Inc. to MLN TopCo Ltd. This Order dismisses the Joint Application of MLN TopCo Ltd., Mitel Networks Corporation, and Mitel Cloud Services, Inc., requesting approval of the transfer of control of Mitel Cloud Services, Inc. to MLN TopCo Ltd. for lack of Commission jurisdiction.

9. Formal Case No. TA 06-4, In the Matter of the Notice of the Indirect Transfer Control of magicJack VocalTec ltd., and YMax Communications Corp., to B. Riley Financial, Inc. This Order accepts Notice of B. Riley Financial, Inc. and magicJack VocalTec Ltd., of a merger transaction whereby B. Riley Financial, Inc. will acquire ultimate control of magicJack VocalTec Ltd. and its indirect wholly-owned subsidiary YMax Communications Corp. Further, the Commission dismisses additional review of this Notice for lack of Commission jurisdiction.

10. RM3-2014-01, Utility Consumer Bill of Rights and Formal Case No. 1140, In the Matter of the Investigation into the Establishment of a Purchase of Receivables Program for Natural Gas Suppliers and Their Customers in the District of Columbia. This Order adopts amendments to Sections 327.36 and 327.37 in Chapter 3 of Title 15 of the District of Columbia Municipal Regulations, governing the exchange of information between natural gas suppliers and the natural gas utility, and the enrollment process for customers switching natural gas suppliers. The rules in Attachment A of this Order will become effective upon the date of publication of the Notice of Final Rulemaking in the D.C. Register.

11. RM402017-01, In the Matter of 15 DCMR Chapter 40 – District of Columbia Small Generator Interconnection Rules and Formal Case No. 1050, In the Matter of the Investigation of Implementation of Interconnection Standards in the District of Columbia. This Order establishes a RM9 Net Energy Metering Working Group to address: (1) system upgrade costs related to the interconnection of community renewable energy facilities (“CREFs”); and (2) to review the Commission’s Net Energy Metering Rules and propose CREF-specific rule changes for the Commission’s consideration. The Commission directs Staff to issue a Public Notice convening the RM9 Net Energy Metering Working Group within thirty (30) days of the date of this Order. Additionally, the Commission directs that the Non-wires Alternatives to Grid Investments working group, established by Order No. 19432 in the Formal Case No. 1130 docket, consider utility ownership of energy storage devices and other distributed energy resources. The Non-wires Alternatives working group shall submit its recommendation on the subject to the Commission for consideration. 

12. RM472017-01, In the Matter of the Investigation into the Public Service Commission’s Rules Governing the Licensure and Bonding of Natural Gas Suppliers and Natural Gas Consumer Protection Standards in the District of Columbia, GT96-3, In the Matter of the Application of Washington Gas Light Company, District of Columbia Division, for the Authority to Establish a New Rate Schedule No. 1A and Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order adopts final rules governing Natural Gas Suppliers in the District of Columbia in Chapter 47 of Title 15 of the District of Columbia Municipal Regulations. The rules shall become effective upon publication of the Notice of Final Rulemaking in the D.C. Register.

13. RM462015-01, In the Matter of the Investigation into the Public Service Commission’s Rules Governing the Licensure and Bonding of Electric Suppliers in the District of Columbia and Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Delivery System for Increased Sustainability. This Order adopts final rules governing Retail Electric Suppliers in the District of Columbia in Chapter 46 of Title 15 of the District of Columbia Municipal Regulations. The rules shall become effective upon publication of the Notice of Final Rulemaking in the D.C. Register.
 

The Public Service Commission of the District of Columbia (Commission) approved nine actions items before the Commission at its August 8th Open Meeting.

The matters include: 

1. Assessments for Fiscal Year 2018. These Orders direct public utility companies, competitive local exchange carriers, competitive natural gas suppliers, and competitive electric providers to deposit their share of the Public Service Commission’s and the Office of the People’s Counsel’s Fiscal Year 2018 appropriated budgets as directed by this Order into the District of Columbia Treasury within 30 days of the date of this Order.

2. Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service in the District of Columbia. This Order initiates the 2018 Biennial Review of Standard Offer Service. Interested parties shall have 30 days from the date of this Order to file comments and 45 days to file reply comments.

3. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the Utility Discount Program Education Working Group’s (“UDPE WG”) Consumer Education Program (“CEP”) Plan for Fiscal Year 2019 (“Proposed FY 19 CEP”) and the Proposed FY 2019 Utility Discount Program (“UDP”) administrative budget and the Proposed FY 2019 CEP budget. The Commission directs the District Department of Energy and Environment to continue its monthly reports and to continue to provide the UDPE WG with a proposed UDP administrative budget and CEP budget for the next fiscal year by December 31 of the prior fiscal year.

4. Formal Case No. 1126, In the Matter of the Office of the People’s Counsel’s Complaint Against Washington Gas Light Company Regarding the Unlawful Compensation of Competitive Service Providers in Violation of its Rate Schedule Number. This Order grants Washington Gas Light Company’s request to clarify the applicability of D.C. Code § 41-108. After reviewing this matter, the Commission modifies Order No. 19324 to exclude any funds deemed abandoned by operation of law.

5. Formal Case No. 1130, In the Matter of the Investigation into Modernizing the Energy Distribution System for Increased Sustainability. This Order approves the recommendations of Smart Electric Power Alliance as described in this Order. SEPA shall file a final working group report, including recommended Commission actions and next steps, for each group within one (1) year from the date of this Order.

6. Formal Case No. 1148, In the Matter of the Investigation into the Establishment and Implementation of Energy Efficiency and Energy Conservation Programs Targeted Towards Both Affordable Multifamily Units and Master Metered Multifamily Buildings Which Include Low and Limited Income Residents in the District of Columbia. This Order establishes an Energy Efficiency and Energy Conservation Working Group to develop a Whole-Building, Deep Energy Retrofit Program targeted primarily towards both affordable multifamily units and master-metered multifamily buildings in the District of Columbia, which include low and limited income residents and consumer education and outreach measures.

7. Formal Case No. 1150, In the Matter of the Application of Potomac Electric Power Company for Authority to Increase Existing Retail Rates and Charges for Electric Distribution Service, and Formal Case No. 1151, In the Matter of the Impact of the Tax Cuts and Jobs Act of 2017 on the Existing Distribution Service Rates and Charges for Potomac Electric Power Company and Washington Gas Light Company. This Order approves the Joint Motion for Approval of the Non-Unanimous Full Settlement Agreement and Stipulation filed by the Potomac Electric Power Company, the Office of the People’s Counsel for the District of Columbia , the Apartment and Office Building Association of Metropolitan Washington, the District of Columbia Government, the Maryland DC Virginia Solar Energy Industry Association, D.C. Climate Action, Baltimore-Washington Construction and Public Employees Laborers’ District Council, Tesla, Inc., Small Business Utility Advocates, DC Consumer Utility Board and Solar United Neighbors and finds that the underlying electric distribution rates contained in the Settlement Agreement are just and reasonable.

8. Formal Case No. 1151, In the Matter of the Impact of the Tax Cuts and Jobs Act of 2017 on the Existing Distribution Service Rates and Charges for Potomac Electric Power Company and Washington Gas Light Company. This Order grants Washington Gas Light Company’s request for additional time to implement the new distribution rates approved by the Commission in Order No. 19395.

9. RM27-2017-01, In the Matter of the Commission’s Investigation into the Rules Governing Local Exchange Carrier Quality of Service Standards for the District. This Order adopts amendments to Chapter 27 (Regulation of Telecommunications Service Providers) of Title 15 of the District of Columbia Municipal Regulations. These rules shall become effective upon the publication of a Notice of Final Rulemaking in the D.C. Register. 
 

The Public Service Commission of the District of Columbia (Commission) approved three actions items before the Commission at its June 20th Open Meeting.

The matters include:

1. Formal Case No. 988, In the Matter of the Development of Universal Service Standards and the Universal Service Trust Fund for the District of Columbia. This Order grants Verizon Washington, DC Inc.’s (Verizon DC) Request for DC Universal Service Trust Fund (DC USTF) Funding Application for the First Quarter of 2018 for the provision of Lifeline telephone service to low-income District of Columbia customers. The Commission directs the DC USTF Administrator to reimburse Verizon DC for the $13,197.89 requested by Verizon DC for the First Quarter of 2018 within 15 days of the date of this Order.

2. Formal Case No. 1125, In the Matter of the Promotion of the Utility Discount Programs. This Order approves the District Department of Energy and Environment’s (DOEE) Invoices for the Second Quarter of Fiscal Year 2018 for the payment of Utility Discount Program administrative expenses. The District of Columbia Universal Service Trust Fund is directed to pay $6,873.17; Potomac Electric Power Company is directed to pay $30,370.07; Washington Gas Light Company is directed to pay $28,921.17; and DC Water is directed to pay $28,971.17 to DOEE within 15 days of the date of this Order.

3. Formal Case No. 1119, The Joint Application of Exelon Corporation, Pepco Holdings, Inc., Potomac Electric Power Company, Exelon Energy Delivery Company, LLC, and New Special Purpose Entity, LLC, for Authorization and Approval of Proposed Merger Transaction; Formal Case No. 1017, In the Matter of the Development and Designation of Standard Offer Service In the District of Columbia; Peppor, Potomac Electric Power Company’s Purchase of Receivables Program. This Order grants in part Potomac Electric Power Company’s (Pepco) Motion for Approval to Recover Costs Related to Forgiven Arrearages (Motion) as it relates only to soliciting comments on Pepco’s cost recovery proposal of Arrearage Management Program (AMP) expenses. Copies of Pepco’s Motion may be obtained as laid out in this Order. The Commission solicits comments and reply comments from interested persons on Pepco’s Arrearage Management Program Cost Recovery Proposal within 30 and 45 days of the date of this Order.

The matters are:

1. Formal Case No. 1151, In the Matter of the Impact of the Tax Cuts and Jobs Act of 2017 on the Existing Distribution Service Rates and Charges for Potomac Electric Power Company and Washington Gas Light Company. This Order admits into the record in this proceeding the Responses to Commission Staff Data Requests of Washington Gas Light Company as described in this Order.

2. Formal Case No. 1150, In the Matter of the Application of Potomac Electric Power Company for Authority to Increase Existing Retail Rates and Charges for Electric Distribution Service and Formal Case No. 1151, In the Matter of the Impact of the Tax Cuts and Jobs Act of 2017 on the Existing Distribution Service Rates and Charges for Potomac Electric Power Company and Washington Gas Light Company. This Order grants the Motion to Stipulate to the Admission of Written Testimony and Exhibits into the Record filed by the Potomac Electric Power Company on June 1, 2018. The Commission also admits into the record several responses to Commission Staff Data Requests as described in this Order.

3. PEPRADR 2018-01, In the Matter of Potomac Electric Power Company’s Residential Aid Discount Compliance Reports and Filings. This Notice of Final Tariff (“Notice”) approves the Potomac Electric Power Company’s (“Pepco”) Rider Residential Aid Discount Surcharge. Pepco’s Rider Update is effective upon publication of this Notice in the D.C. Register.

4. GT2017-02, In the Matter of the Application of Washington Gas Light Company for Authority to add Rate Schedule No. 7 and Formal Case No. 1137, In the Matter of the Application of Washington Gas Light Company for Authority to Increase Existing Rates and Charges for Gas Service. This Notice of Final Tariff (“Notice”) approves Washington Gas Light Company’s High Load Factor Rate Proposal for Combined Heat and Power and Distributed Generation facilities in the District of Columbia (“High Load Factor Rate Tariff”). The High Load Factor Rate Tariff will become effective upon publication of this Notice in the D.C. Register.
